The Kansas Constitution, like the U.S. Constitution and those of other states, calls for a LEGISLATIVE branch and a JUDICIARY. Judges are not to make laws, the Legislature is designed for that purpose.

THE PROBLEM:

Kansas is a conservative state, with a conservative legislature enacting the will of the people as to such issues as taxation, government spending, second amendment rights, death penalty and criminal punishments, and abortion restrictions.


However, the Kansas Supreme Court Justices are routinely and illegally acting as a super legislature, overruling valid laws, in violation of the
SEPARATION OF POWERS provision of the state and federal constitutions.

The same problem has existed in the U.S. Supreme Court for 50 years. However, with the gradual replacement of justices, the high court is being returned to the constitutional format, respecting the founder’s intent to leave law making in the hands of the American people through their elected representatives rather than unelected judges.
